1. Acceptance of Terms
By accessing, purchasing, or using any services provided by Olimpo Hosting LLC ("Olimpo Hosting," "we," "us," or "our"), you agree to be legally bound by these Terms of Service ("Terms").
If you do not agree, you must not use our Services.
You must be at least 13 years old (or the minimum digital age of consent in your country). If you are under the age required to form a legally binding contract, a parent or legal guardian must agree to these Terms on your behalf.
2. Nature of Services
Olimpo Hosting provides hosting services under a rental model. All infrastructure, systems, and base configurations remain the property of Olimpo Hosting or its providers.
Customers receive a limited, non-transferable right to use the Services during the paid billing period.
3. Account Responsibility
3.1 Accurate Information.
You agree to provide true, accurate, current, and complete information when creating your account and to keep such information updated at all times, including without limitation your email address, billing information, and any other contact details.
3.2 Account Security.
You are solely responsible for maintaining the confidentiality of your password and account credentials, and for all activities that occur under your Account. You agree not to share your login credentials with any third party.
3.3 Activity Under Your Account.
All activities conducted through your Account will be deemed to have been authorized by you. If you become aware of any unauthorized access to or use of your Account, you must notify us immediately.
3.4 Verification / Anti-Fraud.
We reserve the right to request additional information or verification (including, without limitation, in connection with suspicious or high-risk orders). If such verification is not completed to our satisfaction, we may refuse the order and/or suspend or terminate the applicable Service.
4. Payments & Billing
All services are prepaid.
Failure to pay by the due date may result in suspension.
If payment is not received within fourteen (14) days of the due date, services may be terminated and data permanently deleted.
All account credits are non-withdrawable and non-refundable unless required by law.
5. Refund Policy
Olimpo Hosting LLC provides hosting services that are provisioned immediately after payment. Because infrastructure resources are allocated upon activation, refunds are limited as follows:
5.1 48-Hour Money-Back Guarantee
New customers are eligible to request a refund within 48 hours of the initial service activation.
Conditions:
- Applies only to the first service purchase per account.
- Limited to one refund claim per customer.
- The refund request must be submitted through the client area.
- The 48-hour period is calculated from the time of activation to the time the refund request is submitted.
- The customer may be asked to provide confirmation before the refund is issued. Failure to respond within 48 hours may void eligibility.
Refund eligibility may be denied if:
- The account shows signs of abuse, fraud, or policy violations.
- A chargeback or payment dispute has already been initiated.
- Custom services or manual work has already been performed (see Section 5.2).
- Multiple accounts are created in an attempt to bypass refund limitations.
Any attempt to create multiple accounts to circumvent refund eligibility will result in permanent suspension of all associated accounts.
5.2 Non-Refundable Services
The following are strictly non-refundable:
- Service renewals (including automatic renewals).
- Custom or manual services (including but not limited to Server Express, configuration work, or any completed labor-based service).
- Account credits.
- Any service clearly marked as non-refundable at checkout.
Once manual work has been completed, the associated fees are considered earned and non-refundable.
5.3 Refund Method
Refunds may be issued:
- To the original payment method
- As account credit
at our sole discretion and subject to payment processor limitations. Certain payment methods may not support refunds. In such cases, refunds will be issued as account credit.
6. Chargebacks & Payment Disputes
We take payment disputes seriously.
If you believe there has been a billing error, you agree to contact us first to allow us the opportunity to resolve the issue.
Initiating a chargeback, dispute, or payment reversal without first contacting us may result in:
- Immediate suspension of all active services.
- Permanent termination of the account.
- Removal of promotional eligibility.
- Restriction from future purchases.
We reserve the right to dispute any chargeback and submit all relevant evidence to the payment processor.
Opening a chargeback automatically voids eligibility for any refund under this policy.
If a chargeback is determined to be fraudulent, abusive, or made in bad faith, we reserve the right to:
- Permanently ban the customer.
- Recover associated processing fees and administrative costs where legally permitted.
- Engage third-party collection services or pursue legal action if necessary.
7. Acceptable Use
You may not use the Services for:
We reserve the right to suspend services immediately if necessary to protect infrastructure or comply with law.
- Illegal activities
- DDoS attacks or malicious traffic
- Cryptocurrency mining
- Hosting public VPN or proxy services
- Copyright infringement
- Resource abuse impacting other customers
8. Server Express / Managed Services
Manual or custom services are limited to the scope described at purchase.
They do not include full development, complex plugin configuration, or unlimited custom work unless explicitly agreed.
Once performed, these services are non-refundable.
9. Backups & Data
Backups may be provided on a best-effort basis but are not guaranteed.
You are solely responsible for maintaining your own external backups.
10. Service Availability
We aim to maintain high uptime. Downtime excludes:
Service credits may be issued at our discretion.
- Scheduled maintenance
- Third-party provider failures
- Customer misconfiguration
- External attacks
11. Disclaimer of Warranties
Olimpo Hosting LLC provides its Services on an “as is” and “as available” basis.
While we strive to maintain high availability and performance, we do not guarantee that:
- The Services will be uninterrupted, secure, or error-free.
- The Services will meet your specific requirements.
- Any defects will be corrected immediately.
- Data will never be lost, corrupted, or compromised.
Use of the Services is at your own risk.
To the fullest extent permitted by applicable law, Olimpo Hosting disclaims all implied warranties, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
Some jurisdictions do not allow certain warranty exclusions. In such cases, the above disclaimers apply to the maximum extent permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law:
Olimpo Hosting LLC, its owners, employees, affiliates, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:
- Loss of profits
- Loss of revenue
- Loss of data
- Business interruption
- Loss of goodwill or reputation
Even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to the Services shall not exceed the total amount paid by you for the affected Service during the three (3) months preceding the event giving rise to the claim.
The remedies described in these Terms are your sole and exclusive remedies.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Olimpo Hosting LLC, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from:
- Your use of the Services.
- Your content or data hosted on our infrastructure.
- Your violation of these Terms.
- Your violation of any applicable law or third-party rights.
We reserve the right to assume control of the defense of any matter subject to indemnification, at your expense.
This obligation survives termination of your Services.
14. Copyright & DMCA Policy
Olimpo Hosting respects intellectual property rights and expects its customers to do the same.
We may take action if we determine that your content violates these Terms, the Acceptable Use Policy, or if we receive a valid legal notice, such as a DMCA takedown request. Such action may include removing the content, suspending your services, or permanently terminating your server, at our sole discretion.
In more serious cases, such as the hosting of unlawful material, we may also notify and cooperate with appropriate law enforcement authorities. Although we will attempt to provide advance notice whenever reasonably possible, we reserve the right to act immediately and without prior notice if doing so is necessary to comply with the law, protect other users, or maintain the security and integrity of our infrastructure.

15. Governing Law
These Terms and any dispute arising out of or relating to the Services shall be governed by the laws of the State of Florida, United States, without regard to its conflict of law principles.
Before initiating any formal legal action, both parties agree to attempt to resolve the dispute informally for a period of thirty (30) days from the date written notice is provided.
If a dispute cannot be resolved informally, it shall be brought exclusively in the state or federal courts located in Florida, United States. You consent to the personal jurisdiction of such courts.
Nothing in these Terms limits any non-waivable consumer protection rights applicable in your jurisdiction.
16. Miscellaneous
If any provision is invalid, the remaining provisions remain enforceable.
Failure to enforce any provision does not constitute waiver.
